Essential Requirements for the K-1 Visa:
- Legitimate Commitment: The foreign national and his or her American partner must be free and have a genuine intention to marry within 90 days of the fiancé’s arrival in the US.
- Personal Meeting: The couple must have met in person within two years before submitting the visa (there are exceptions).
- Financial Eligibility: The American partner must demonstrate sufficient financial capacity to support the foreign fiancé during his or her initial stay in the country.
- Clean Criminal History: The foreign fiancé must undergo criminal background checks to ensure that he or she does not pose a threat to the national security of the United States.
- Clean immigration record: The foreign fiancé must check whether there are any irregularities in the past (e.g. deportation or illegal presence) to ensure that he will not have an admissibility problem
Exceptions to the K-1 Visa
While the K-1 visa is a viable option for many couples, there are certain exceptions and situations that may impact eligibility.
- Ineligibility for Security Reasons: If the foreign fiancé or partner in the United States poses a threat to national security, they may be denied a K-1 visa.
- Previous Visa Violation Cases: If the foreign fiancé or partner in the United States has violated immigration laws in the past, this may affect eligibility for the K-1 visa.
- Failure to Meet Previous K-1 Visa Requirements: If the foreign fiancé or sponsor in the United States has not met the K-1 visa requirements in a previous attempt, this may complicate obtaining the visa in future attempts.
Step by Step Process
1. Registration of the Petition:
The U.S. citizen must submit Form I-129F, Petition for Alien Fiancee, to USCIS.
2. During the process
It is important that the American citizen’s address is always up to date so that communications are not lost.
3. Approval and Forwarding
Once approved, USCIS forwards the petition to the National Visa Center (NVC), which then sends it to the U.S. Embassy or Consulate in the country where the foreign fiancé is located.
4. Visa Application
The foreign fiancé must register the process in the US Department of State system, pay the fees online, complete the DS-160 visa application and gather the necessary documents and attend a medical examination.
5. Interview
The last step is an interview at the US Embassy or Consulate, after which the visa may or may not be approved.
6. Visa Approval
Once the visa is approved, the foreign fiancé will receive his passport with the visa and a sealed envelope to present upon arrival in the USA.

Frequently Asked Questions
After marriage, the foreign spouse may request to change their status to lawful permanent resident (green card holder) by completing Form I-485, Application to Register Permanent Residency or Change of Status. This process allows them to live and work permanently in the United States.
If the wedding does not occur within the 90-day period, the foreign fiancé(e) must leave the United States. Failure to do so may result in legal consequences and affect future immigration applications.
Yes, the US citizen fiancé can visit the foreign fiancé during the visa process. However, it is important to ensure that visits do not violate the terms of the K-1 visa application, such as exceeding the permitted length of stay.
If the K-1 visa petition is denied by USCIS, the applicant will receive a notification explaining the reasons for the denial. Depending on the circumstances, the applicant may have the option to appeal the decision or reapply for the visa with additional evidence or corrections.
Yes, the foreign fiancé's children may be eligible to accompany him or her to the United States on a K-2 visa. The applicant must include the names and information of the foreign fiancé's children in the Form I-129F petition, and separate visa applications must be made for each child.
There is no specific annual quota for K-1 visas. However, visa processing times and availability may vary depending on factors such as USCIS workload and country-specific visa demand. It is essential to monitor processing times and plan accordingly.
